Terms of Service

1. Eligibility

The Original Snake is a general-audience game. By using the Service, you represent that you are at least 13 years of age, or that you are using the Service with the consent of a parent or legal guardian. If you are under 13, you may play the game but should not submit scores to the leaderboard without parental consent.

2. Use of Service

The Service is provided free of charge for personal, non-commercial entertainment. You agree not to:

• Submit fraudulent scores or manipulate the leaderboard.
• Use offensive, abusive, or inappropriate nicknames.
• Attempt to exploit, hack, reverse-engineer, or disrupt the Service or its infrastructure.
• Use automated tools, bots, or scripts to interact with the game or APIs.
• Circumvent rate limits, anti-cheat measures, or access controls.
• Use the Service for any unlawful purpose or in violation of any applicable laws.

3. Leaderboard Content

By submitting a score to the leaderboard, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to display your chosen nickname and score publicly on the Service and in connection with sharing features (such as social media previews). You represent that your chosen nickname does not infringe on any third-party rights.

We reserve the right to remove, modify, or refuse any leaderboard entries at our sole discretion, including entries with offensive nicknames, fraudulent scores, or entries that otherwise violate these Terms.

4. Intellectual Property

The Original Snake is an independent fan recreation inspired by the classic Snake game concept, which is in the public domain. The source code, design, and content of this Service (excluding third-party trademarks) are the property of the operator.

This project is not affiliated with, endorsed by, sponsored by, or in any way connected to Nokia Corporation, HMD Global, or any of their subsidiaries. Any references to Nokia or Nokia products are for descriptive purposes only and do not imply any association or endorsement.

5. Advertisements

The Service may display third-party advertisements through Google AdSense. We are not responsible for the content, accuracy, or practices of third-party advertisers. Your interactions with advertisements are governed by the respective advertiser’s terms and policies.

6. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service (or any part of it) at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the Service.

7. Termination

We may, at our sole discretion, restrict or terminate your access to the Service at any time, without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Any leaderboard entries associated with your nickname may be removed.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that leaderboard data will be accurate or preserved.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall The Original Snake, its operator, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from or related to the Service shall not exceed one hundred US dollars ($100), except to the extent such limitation is prohibited by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless The Original Snake and its operator from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in the State of Florida.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. 14. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms caused by events beyond our reasonable control, including but not limited to natural disasters, internet outages, third-party service failures, or government actions.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or the right to enforce it at a later time.
